Terms and Conditions on Data Protection (“TCDP”)

“Globuyteam” refers to the service provided subject to these General Terms and Conditions of Use and these Terms and Conditions on Data Protection (“TCDP”) and/or Globuyteam GmbH.

The protection of your data is of utmost concern to Globuyteam.

In these terms and conditions on data protection Globuyteam would like to inform you about how Globuyteam treats your data and how you can exchange this data with other users of Globuyteam.

These terms and conditions supplement the General Terms and Conditions of Use for using Globuyteam.

1. Basic Principles of Globuyteam for handling your Data

Globuyteam strictly adheres to the following basic principles in the protection of your Data:

• Globuyteam shall collect, process and use your Data in accordance with the laws and statutes on data protection of Switzerland.
• Globuyteam shall use your Data solely to provide you the Globuyteam Services on the Internet for which you have registered. Globuyteam will never pass your Data on to any third party, neither for advertising, nor for marketing for any other purposes.
• Persons not registered with Globuyteam may not view any of your Data.

2. Definitions

The following terms used in these TCDP shall have the following meanings:

• « Login Data » shall mean the data enabling you to access your account.
• « Company Data » shall mean the data related to your company.
• « Company business Data » shall mean data related to the activity of your company.
• « Contact Data » shall mean data enabling you to be contacted by Members.
• « Purchasing Data » shall mean data related to your purchasing activity within your company.
• « Personal Data" shall mean your personal data.
• « Globuyteam Websites » shall mean all websites on which Globuyteam provides the Globuyteam Services.
• « Globuyteam Members » shall mean all registered users of Globuyteam on the Globuyteam Websites.
• « Globuyteam Services » shall mean all registration based services provided by Globuyteam on the Globuyteam Websites.
• « Registration Data » shall mean the Data you are obliged to make available to Globuyteam in the registration process for the Globuyteam Services.
• « Profile » shall mean the Globuyteam Website page where the Data you have made available to Globuyteam is displayed in accordance with your specifications and your consent.

3. What does Globuyteam know about you, what do you give Globuyteam and Globuyteam Members permission to do, and what happens with your Data?

3.1 Registration Data

In order for the Globuyteam Services to function, Globuyteam needs to collect and process certain elements of your Data in the course of the registration process. First of all, this consists of the following data:

Login Data

• Login (email address)
• Password

Your password is never visible to any Globuyteam Member at any time. Globuyteam shall never disclose or pass your password on to any third party.

Furthermore, you will need to fill out the following Data in the course of the registration process (*mandatory fields):

Contact Data

• First Name*
• Last Name*

Company Data

• Company Name*
• Company Address*
• Holding/Group
• Business Group
• Business Unit
• VAT number

Company business Data

• Business field*
• Business field description*
• Sales turnover*
• Number of employees*
• Total company yearly purchasing spend*

Your Contact and Company data remain confidential and might only be disclosed if you accept to be in contact with another Member.

3.2 Purchasing Data

The Purchasing Data enables you to find and contact other members.

Your Purchasing Data are visible for Globuyteam Members but your contact details remain confidential and might only be disclosed if you accept to be in contact with another Member.

4. Members searches and display of search results

The Globuyteam Services offer various possibilities to search for particular Globuyteam Members, including a Search feature and a Search Alert feature. The search functions help you to initiate contact with other Globuyteam Members who offer exactly what you are looking for. Thus, you can find the contacts you need and systematically expand your network.

Member searches can only be made on the following data of the members (and only this data and the spoken languages from members will be disclosed):

• Country and Region of your company

Company business Data

• Business field
• Business field description
• Sales turnover
• Number of employees

Purchasing Data

• ec@ss
• Yearly spend
• Sourcing region
• Destination region
• Keywords

Remark

Each Member is anonymous towards other Members until he has accepted to be in contact. Your following data will never be disclosed to other Members without your acceptance:

5. Visible data during a contact request

If you send a contact request to a Member, your following data are visible to the requested Member:

• Job position

Company Data

• Company Address (country and region only)

Company business Data

• Business field
• Business field description
• Sales turnover
• Number of employees

Purchasing Data

• ec@ss
• Yearly spend
• Sourcing region
• Destination region
• Keywords

6. Visible data after acceptance of a contact request

After having accepted a contact request with another Member, your following data will be exchanged with the ones of the other Member:

Contact Data

• Last name
• First name
• Phone
• Email

Company Data

• Company Name
• Company detailled address
• Holding/Group
• Business Group
• Business Unit

Purchasing Data

• ec@ss
• Yearly spend
• Sourcing region
• Destination region
• Keywords

You will then be able to contact the Member directly offline.

Remark:

If you send Globuyteam Members a request for contact, these Globuyteam Members are then saved on your contact list. Should a Globuyteam Member accept your request for contact, this Globuyteam Member shall be listed with his/her Contact Data. Other Globuyteam Members will not view your list of accepted contacts.

As you can see, Globuyteam gives you complete control over your own privacy at all times!

7. Visibility of your Profile to Non-Members of Globuyteam

None non-member of Globuyteam will have access to your information.

8. Groups

On the Globuyteam Websites, Globuyteam offers Groups.

Each group has one moderator. The moderator decides for each group who has access for each relevant group.

Groups are not forums but simply an additional categorization way offered to Members to find other Members.

The contact request between Members of a same group will be done in the same way as for a Member search

9. Invitations

As a Globuyteam Member you may invite others to join Globuyteam. Globuyteam shall process data collected in the course of the invitation solely for the invitation and shall not use it for any other purposes.

Please note that the following sections of your Data are displayed to the recipient of the invitation:

• First Name
• Last Name

10. Newsletter, weekly Status-Emails

Globuyteam regularly sends out newsletters or weekly status emails (collectively hereinafter referred to as the "newsletter(s)") to all Globuyteam Members. In these newsletters Globuyteam may inform you, among other things, about new features on Globuyteam.

You may choose to unsubscribe from the newsletter at any time by sending an email to the link provided at the end of each newsletter.

11. Cookies

After you have logged in to the Globuyteam Services with your user name and password, Globuyteam uses cookies in order to identify you during the course of your session. A cookie will be stored on your computer. Upon the termination of your session the cookie will be automatically deleted. You can save this cookie on your computer to enable automatic login for subsequent sessions by activating the function: "Login automatically on this computer". The cookie will then store part of your login data in encrypted form. If you select automatic login, please be aware that this will then only be possible on the same computer on which the cookie was first saved, i.e. an automatic login on two (2) different computers is not possible.

12. Log Files

Each time you access a website from the Globuyteam Websites, Globuyteam will save the following data in a log file (the so called "server log"):

• Your IP address (by which your computer can be clearly identified),
• The name and IP address of the computer requesting the respective page from the Globuyteam Websites (the so called "remote host computer"),
• The time, status, and amount of the transferred data, as well as the Internet website from which you have reached the requested page of the Globuyteam Websites (the so called "referrer")
• The product and release information from your Internet browser (the so called "user agent").

This log file will be stored by Globuyteam in the standardized "combined" log file format for the Apache Web server. Globuyteam uses the data from this log file in anonymous form without reference to your person for statistical purposes. In doing so, Globuyteam may analyze on which days and at which time the Globuyteam Services are particularly frequented and how much data volume is created on the Globuyteam Websites. Furthermore, by using the log file, Globuyteam can identify defects on the Globuyteam Websites, such as defective hyperlinks or program Globuyteam, and thus continually improve the quality of the Globuyteam Websites. Globuyteam does not attribute the website demands stored in the log file to specific individual users. However, Globuyteam reserves the right to review the log files from the last known IP address of a Globuyteam -Member where Globuyteam has reasonable cause to believe that the member is using Globuyteam Services in breach of contractual agreements or the applicable legislation. In doing this, Globuyteam is protecting other Globuyteam Members, the safety of Globuyteam Members’ data, as well as Globuyteam Websites and the Globuyteam Services.

13. Under Age

Membership of Globuyteam Services is reserved to persons who have reached the legal age of 18. Parents and legal guardians are responsible for the protection of their children's privacy.

14. Changes to these TCDP

Globuyteam reserves the right to amend these TCDP, in the event that this becomes necessary due to gaps in these Terms and Conditions on Data Protection identified after their release, or in the event that it becomes necessary with respect to additional or amended services provided by Globuyteam. Globuyteam will notify you of any amendments to these Terms and Conditions on Data Protection by email to the email account you provided to Globuyteam in the course of your registration.
